最近,一名加州代孕母亲发现自己在为一对中国夫妇代孕的同时,怀上了自己的亲生孩子。此种情况是由一种罕见的医学现象“异期复孕”所引起的。“异期复孕”指的是当孕妇体内已经怀有胎儿时,她又开始另一周期的排卵,第二次排出的卵子又恰好受精成了胚胎。所以,虽然这名代孕母亲认为她怀的是双胞胎,实际上这两个孩子的父母并不同。 但是,直到两个月后这名代孕母亲才收到这两个宝宝并不是双胞胎的消息。通过DNA测试,医院发现她怀的第二个孩子,并不是代孕委托人的孩子,而是代孕母亲的亲生孩子。但是,直到数月之后,这名代孕母亲才重新获得抚养自己亲生孩子的权利。她所生的两个孩子的抚养权,在孩子出生时,已全归委托代孕的中国夫妇所有。在意识到代孕母亲才是另外一个孩子的亲生母亲时,这对中国夫妇不得不把孩子送去孤儿院。只有这样,这对中国夫妇才能放弃对孩子的抚养权,然后让他的亲生父母通过收养的方式重获抚养权。 此案例凸显了,代孕法律合同对于代孕母亲和代孕委托人的重要性。不管你是代孕母亲还是代孕委托人,都要严谨把控代孕合同上的所有条款。确保代孕合同的条款中,不仅包含了能够处理代孕意料之中的潜在风险,以及意料之外的情况。
